my mom got into an accident (she crashed right into a store, long story) the insurance covers 25000 in property damage but the estimated damages is 42000, the store has some business insurance but will they sue my mom, im kinda of distraught right now, serious answers only please

Have you asked your insurance if you are involved in litigation, will they provide a lawyer ( of course their best interest is for the insurance). If not best get a lawyer quick. To protect your mom, is she allright?

yah were consulting a lawyer...my moms ok just shakened, i rushed to the scene everybody was ok, no inujuries, the owner of the shop was taking care of my mom at the scene, is it ok if I contact the shop to see if there going to sue, or is that a no no

Personally I wouldn't talk to the shop owner at all till you do get a lawyer, you don't want them to take any thing you have said and have them use it against your mother. Have you gotten a chance to get your moms version of events. Also did she say ANYTHING to admit fault?

Contact your Mother's insurance agent and tell them to get the insurance adjustor in contact with the store as soon as possible. Do NOT contact the store yourself. Your mother's insurance company will (should) hire a lawyer to represent your mother under her insurance policy should the store threaten (or actually bring) a lawsuit. The store is very likely (99%+) going to settle for the $25,000 policy limits. I don't know where your mother lives but many states have laws that limit the assets that can be used to pay off a judgment. Frankly, most elderly women don't have a lot of assets that could be used to pay a judgment so the store will very likely take the policy limits and use it's own insurance to fix the damage.

In summary: Contact your mother's agent and make sure they are handling the claim. Do not contact the store yourself. Do not allow your mother to give a statement to anyone other than your mother's insurance company. And finally, your mother's insurance policy will pay the cost of defending your mother should the store want to file a claim (this is separate from the policy limits).:readit:

yah shes totally at fault, carpet got stuck btw the gas and brake, so when she stepped on the brake she was stepping on the gas, the insurance company has her at 100% at fault, but when i went to the scene, there wasnt that much damage just a glass wall and a desk and some cabinets, no machinery.....I should of took pix, but i was only concerned about my mom....i just want to know if there going to sue or not, so i could get things prepared

thanks so much for your advice, man im a total wreck right now, and your words are given me some confidence, eventually if my mom gets sued Ill end up paying for it. so its 17000 which kinda of puts a stake through my heart..so

Which insurance finds her at fault? Her own?! Hmmmmmm. Pictures? GO back and take some pictures to document visible damage to the store so they can't make up more damage than there really is. Try to document as much as possible. Be discreet. I know this is a bad time but the most important thing is you mother is okay and nothing happened to her. Money can be replaced your mothers health can't. Take it one step at a time.

her own insurance finds her at fault, yah i know, i should take things one at a time, thanks man, i just got overwhelmed for a moment, Ill take the advise not to contact the shop, ill keep u guys update on whats happening, again thanks guys....so happy I could turn to u guys for help
