I recently put $500 down for a deposit on credit card for the MDX tour with nav. I decided to not take the vehicle at the end and the dealer says that they are not giving me my money back. Is that legal? I mean I didn't purchase anything. I should be able to get my money back right? Thanks, Paul

Read the contract you signed with the deposit. It likely says the deposit is non-refundable. However, most dealers give the money back to maintain a good relationship in case you buy there in the future. If you have tried nicely to retrieve your deposit and it didn't work, then call Acura corporate to complain. If that doesn't work, then make a big stink at the dealership on a busy day about never buying from them due to their lousy business practices.

You also might call your credit card company and lodge this dispute with them. They should work with you to get it resolved.

I just checked the order form that she gave me and I didn't sign it. It only had the dealer's signature. I didn't sign any contracts, I think. Could I be off the hook?

I was just unhappy with the way they were treating me, esp. the finance person- she really needed some people skills. The dealer was so dishonest also. Kept trying to rush me to pick the car, telling me the $1500 market support was going to be over last week and telling me I could only get a lower rate if I give an answer the at the end of that day. I can still get the same price and rate today from her.

If you didn't sign it and they accepted that - you are off the hook. If they still give you a hard time, then drop a few "talk to my lawyer", "call Acura corporate", "never buy from this dealer again", and "call BBB" references and I bet you'll get your money back. Since you didn't sign anything, the suggestion by Dr. Ken will also work but will take longer.

Yeah i just called my credit card company, they told me to give the dealer 30 days to give me my money back. Then after that they will try to get my money back but they said that they were not 100% sure that they could get it back. This just tells me that having platinum status with a card company means nothing.
But thanks for everyones help, I'll keep everyone updated. Paul

Just post the name of the dealership here and we can all take turns lambasting them. Maybe someone else has a horror story about them.

I'm guessing Metro in the Philly area or in South Jersey Sussman or Turnersville.

No brainer

No signature, no contract.

Did you sign a credit card receipt?

If not, just tell the card company they charged you and shouldn't have- tell them you never authorized the original 500- forget about a contract, etc. If pressed, tell them they asked for the CC number just to hold it in the future.

Figure out the rules then conform your story to the facts as documented and the rules-stay away from "they said" all that counts is what's documented.

What scum.

Plantinum, Schmatlum- everyone is getting Plat cards. Run 15-20k a month on a card and THEN you'll get service.

Hi:

I was reading your post about how your dealer was trying to take your $500 and noticed that nobody mentioned contacting the local news channels. Most news departments have a consumer fraud segment in their newscast. Having been in television for over 10 years I know that stations are always looking for stories like this. Just mention to the dealer that you'll be contacting WXYZ Channel 7 Action News about your experience and I would be willing to bet they will take whatever steps necessary to get you off their backs. At this point, I do not want to talk to those people ever again. I'll give Acura a call and complain about my experience at this particular dealer. This is Sussman Acura of Jenkintown, by the way. I will never set foot with anything named Sussman ever again.

Something on a happier note- I picked up my car at Davis Acura. I got a silver touring with navi. They gave me the same price and every other oil change is free plus wheel locks. They were much nicer, my salesman took half an hour to help me set up onstar and explain the navigation. The whole atmosphere at the dealership was better. Not to mention the attractive ladies that worked there. I was just drooling as one of the ladies was explaining all my paperwork and having me sign them. I don't even know what I signed-- haha.

If you put a $500 deposit on a car and didn't take delivery of it, they owe you $500. It's outrageous that they're giving you a hard time about returning the $500 to you. Call/write/email the owner of the dealership.

If you don't get your $500 back in 30 days call Acura Corporate and tell them about the situation. Follow up with a letter.

Finally, write both of the above and tell them you're writing the Better Business Bureau and several newspapers.

For future reference come to a forum like this and ask people who they've used. You'll most certainly hear from someone who's dealt with a local dealer of yours.

Make as big a stink as you can at the dealer, corporate, etc. And definitely continue with the credit card company.

I dealt with Sussman in Jenkintown once. Got the newbie service writer who told me he was transferred there and didn't want to be working there. Nice.

Told them not to wash it, they did. Also sprayed something on the tires that turned them orange in spots and splashy. Said I must have driven through something. Told them to check the tranny, never left the lot (As evidenced by the mileage on my notes I wrote before dropping off and the service sheet.) Then he said he forgot to write the mileage and used whatever mileage was on it when it came back in.

One trip was all I needed to get lied at and not go back ever again.
