Need some info with insurance and dmv - Click HERE for Original Thread

I'm trying to get some info for my little brother (his car's under my name).

Anyway, my brother owns a 95 Integra GSR and recently damaged the left side of his car exiting the freeway, I'm guessing he hit something, maybe a wall or rail (cops were there). It's pretty bad. The damage of the car should cost more than the price of the car itself. It's pretty much totaled.

The question is, he doesn't want to report it to the insurance. He wants to report it to the DMV as non-operable and just cancel the insurance. He's fearing he'll get a point. If he reports it to his insurance, I know they'll cut him a check for the price of the car. But he doesn't want to.

And, he wants to keep the car for parts. So, if he reports it to the DMV as non-operable, can he keep the car and sell it for its parts? I know for the insurance side, he could just cancel it and not get any money for the car. I rather report to the insurance myself, but he doesn't want to. So, the question is, if he reports it to DMV that it's no longer drivable, can he still keep it and sell it for parts? Or does anybody have any other ideas?

I'm asking because the car is under my name so whatever he decides it effects me. Thanks in advance for any info.

Since it sounds like there's more than $750 of damage to the vehicle and/or public property, your brother will have to do the SR1 form within 10 days. http://www.dmv.ca.gov/forms/sr/sr1.htm It'll be on the DMV report and the insurance company will know about it.

Your post said the cops were there. Sounds like the DMV should already know about the accident. Your insurance company may also know as aI imagine that the police asked for insurance information at the scene.

I think I would rethink your whole scenario.

The cops were there only to check things out because he was somehow blocking the road and he called the tow truck for my brother. He asked he my brother wanted to make a police report, he said no.

So, now his options are report it to his insurance, take the money for the car and get a point most likely. Or, just report it to DMV as a non-operable vehicle and cancel his insurance without telling them.

He wants to keep the car because he wants to sell parts. Can that happen at all? Report it DMV as non-operable and sell the car parts?

Dude it's your (or his) car............. you can do what you want. If you want to drop the insurance, that is your right.

It is paid for right? Or is there a lien on the car?

The car is his, I sold it to him and it's under my name. He is 19.
