Bought an X5 about 2 months ago from a dealer in NYC. Traded in an 04 MB in the process.
Up to now, I am receiving phone calls from MB Credit that they have not gotten payment from dealer and that we are on the hook. I called the dealer and they say they've sent the payment. I'm getting worried about this.
I don't want to file any sort of legal claim due to the length of time it may take. In fact, I'm leaning on filing a stolen car claim just to light a fire under them.
Also, while looking over the contract, they charged me $285 for the registration and title. I don't mind since I really got the vehicle for about $6k under normal book value but of course it is still money.

Exactly....I was thinking you should send the dealership a letter on your letterhead :-) |

Phone calls don't preserve your rights. Send a short letter to both, on your letterhead, leading off with "Under the terms of the Fair Credit Reporting Act, and other applicable regulations, I dispute the total amount of your bill dated so and so. A paragraph of explanation, and you're done.
This starts the clock on the FCRA dispute resolution time limits. THey must reply to you in X days, you must reply to them in Y days, etc etc.
THe best thing is that if MB Credit gets stupid and reports this as a bad debt, they must also report that it has been disputed and pending mediation. THey can't call with threats until it's resolved.
Phone calls leave no record. |
