This is for those who have read my oil leak thread.

My case with the BBB is moving along and will most likely move to arbitration. The case manager informed me that I could bring in evidence along with written documents. I am asking for a replacement and or refund for what I and my MDX have gone through and would like all of your input. In other words, if you were in my position, what would you expect out of the situation.


Thanks to all who respond for your time and unless im asked not too, I will print each post and bring this with me to show Acura Corporate.

I'd be asking for the same as you. The value of your time, and the amount of frustration that you've had is what's really important (beyond the mere value of your MDX). It's too bad that Acura hasn't stepped in to make your situation right. Very short-sighted of them.

A good idea in cases like this is to document everything. If you speak to ACS (or any other customer service department), follow up with a letter - and send it registered (or at least keep a record of all conversations). You could even copy or write to the president of Acura U.S. If the car company has been negligent in responding to your complaints, this will weigh heavily in your favour with the arbitrator. I've had to go to arbitration once and had a good result because I had all the documentation needed to support my case. The car company actually settled 2 days before the arbitration hearing.

teck, what you are asking for is very fair and reasonable... im sure you work full time and the time you must have spent dealing with all this garbage while on the job alone is worth something.... not to mention the fact that a car that costs 35K+ and gives that many problems should be replaced or the price refunded with NO HASSLE WHATSOEVER..... these people are getting a serious premium for this vehicle, much more so than almost any other car on the market(id mention this in arbitration BTW) and there's no excuse for this type of treatment when you have paid for the car AND THEN SOME...... id also mention the JD power ratings that acura dealers have to show that your problem isnt an isolated one and that this experience with this dealer isnt an exception... print out the dealer ratings about esserman on this site also.... this wont exactly help the facts of your case but will show that there is a climate at some acura dealers to sell you the car then shaft you when problems arise.....

I would definitely request a new MDX or your money back. This kind of dramatic rework on a brand new car is unacceptable. I would equate it to buying a new home and then the builder comes back and says the foundation is cracked. The builder then puts you up in an apartment, and patches your foundation. If the foundation were completely removed and a brand new one put in, that would be one thing...

In other words, you deserve a new truck, and maybe even a little bit more in the way of factor/dealer options on top of that for your trouble (considering the shoddy workmanship you first experienced).

My 2 cents--best wishes bud, in a terrible situation.

Thank you all for your response. BBB guy said arbitration would be sometime in September. I would not wish this to my worst enemy.
