Well, this is my first real post on this website, though I have been lurking for a long time now. Sorry for the long post but I need a little advice.
To give you a little recap:
I have a 2006 Touring with Navi and RES that I bought new. This has been the best and nicest vehicle that I have owned. Well that is about to change. Last Wednesday my wife was travelling north at the end of a long line of traffic at about 10 – 15 mph when out of the blue the driver in a pickup, travelling at about 50+ mph didn’t realize that there was slower traffic ahead of him and plowed into the Acura. The collision launched my wife from the right lane to the middle lane, luckily there was no one there, where she was able to gain control and get over to the side of the road. As you can see from the pictures of the “Goob’s” truck, his was not drivable. Big praises to Acura there. From what the driver (who got a ticket) told us, he and his passenger were looking for a restaurant, not paying attention, when the passenger shouted “look out!”, whereas the driver was able to swerve just enough to not hit my wife full on.
The driver and passenger were employees driving a company vehicle so you would think that the companies insurance would cover this. Such is not the case though. The insurance company, Continental Western Insurance, is stating that the driver was not on company business and not allowed to take it to dinner so they are not covering it. The accident happened in Colorado Springs and the construction company is in Denver so how else he would get to dinner is anyone’s guess. So far it looks like the damage will be over $10K. What do you all think that I should do now? |

Glad no one was hurt. Car/possesions can be replaced, not family.
From the picture, it looks like cosmetic damage that can be repaired. Assuming the other party's insurance paid $10K for the repair, that would take 12-18 months until the official check. In the mean time your insurance company normally will offer the coverage for the repair & once the case settle, will try to get the money back from the faulty driver's insurance.
Would your MDX be the same after the repair? Definitely not. You have a lot of options to think about. All depends on your pocket & how you want to play it out. Normally I would trade it in for something else. Good luck.

| Glad no one was hurt! Make sure to have the frame checked out......looks like the right rear door is out of alignment and you need to make sure the frame has not been compromised. |

Your insurance company should work the problem for you. If for some reason they will not then it is lawyer time.

Bad crash like that, your wife was injured. She may not know it yet, but she suffered severe trauma.
First- wife to a doctor, complaining about her injuries. Her neck, head, ears, all the things are are aching. I am not kidding, nor am I exaggerating.
Next, file with your own physical damage insurer and have the damage repaired. New car like that, get Acura repairs. Insurer will try to tell you their "procedure" is that they will only pay for used parts, or cheap repairs, or non-OEM parts. Many states outlawed that because of the rampant abuse of the consumer. You have to pay your deductible. Your premium may increase for several years, depending on how the policy is written. Some say that "damage to the rear of your vehicle" is not chargeable. Others say "damage that does not result in them paying a claim" is not chargeable.
Finally, hire an attorney on contingency and sue the bastard. Both the bastards- both the driver and the owner. Let them figure out who's going to cover. Trying to disclaim covearge for your damage, because the other driver was allegedly abusing company policy is something like turning down the medical coverage of a lion-attack victim because the lion didn't brush his teeth before it bit. That's where the doctors reports come in.
By the way, that's not cosmetic. The frame looks bent- look at the gap in the right rear door. |
