I just put a deposit on a sage brush. My salesman told me MSRP, and thats it. Now he tells me its an extra 488 for the roof rack, and 499 for something called a "protection package". :3: I've been talking to him for months!!!! He knows I don't want this?? Then I say, "credit back my card". He says... let me talk to my manager. At this point I'm so pissed off that I really don't care if he comes back and says, we'll leave it off. What would you guys do?

Dude...I go talk to the Site Manager, The Sales Manager and the people that own the dealership.

That is down right dirty. I HATE DIRTY business~

I'd be pi$$ed, too.

Different states have different laws, and I don't know what state you're buying in, but I suspect auto deposits are refundable in every state. Dunno for sure. In California, they have to give your deposit back if you ask for it -- you don't have to justify why.

Just remember, based on many experiences here, lots of dealers $uck. However, once you have your MDX, it feels better.

You have to weigh rewarding their crappy behavior versus getting your own reward.

Also remember, if you do purchase from them, you can return the favor on the customer satisfaction survey.

He probably has another buyer for the one you ordered that is willing to pay whatever he wants for it. Maybe some arm-chair attorneys or actual attorneys can chime in on what your deposit represents. If it is an order for a product where the money exchanged signifies an agreement to terms and those terms did not include what they are now telling you to buy - then you may have a case to hold them to the original order. I would ask myself this...

Can I wait longer for the vehicle and order from someone else who hopefully won't pull a stunt like this?

Are there other Acura dealerships in my area that I can call and orer from?

Some things you really should add to your post:

1. The name of the dealership, location and salesman.

2. Tell us whether you have paperwork signed saying there are no forced options or that outlines the total cost including TTL that you've signed. That's important. Did he tell you about the extra $1K AFTER you signed the order with the deposit or after?

I personally would say a big F-U to the sales guy and order elsewhere.

___Sounds like a typical old style Acura dealer switch … After the past discussions of Acura corporate coming down on the unscrupulous dealerships, I thought that this kind of non-sense was over. If your dealer doesn’t come back with MSRP + only the DIO’s you want, tell them to pack sand. And this is the same dealer that was offering you 1K under MSRP on the TW base just yesterday, right? I can’t believe this!

As was stated earlier, the legality of keeping deposits may well be governed by state law. Even if the contract simply states that you will pay MSRP, you will not likely have much of leg to stand on, unless you have a VIN number or a definite delivery date, you don't have much of a contract. They can, however, keep pushing you back in the line. In all likelihood, they will not be able to keep your deposit, unless they can show damages. That is not likely with a backlog of buyers.

I would go there, demand to speak to the owner and get some satisfaction. Either a definite delivery date, or a refund.

Now he calls, and says "we refunded you card as a sign of trust", no options forced now, and he says the car is still mine and he appologizes. Hmmmmm. Sounds like they gave my money back IN CASE someone else falls for it??

BTW, this is NOT the same dealer as the TW was at. From what I can tell, they were being honest/desperate for some reason. This dealership (Valencia) is the one I've been dealing with for 6 months.

Simple.. They are covering their :bootyshak :moon: It is an all to common tactic. Do the searches, you'll find plenty of examples of this assinine behaviour :3:

When I left a deposit with Hopkins, an agreement was written up stating the exact price as delivered.
Although, I bailed out because another was available sooner that I wanted, the agreement was binding upon delivery of the requested vehicle.
I had a copy of that agreement. If it's in writing I don't see how they have a leg to stand on.
If it's not in writing, you learned a valuable lesson, but I still think you can make them stick to the deal. They have so much as admitted that was not the original agreement. It would hold up in court. (not that it should ever go there....!)

IMHO, I think most of these BS add-in options after the written deposit are the acts of salesman's greedy. They want to maximize their commission on MDX. I believe MDX are divided equally some how among salesmen. Once you're pissed and wanted to talk to the GM or owner, they will back out; else they'll get into trouble.

Dude, get the away from this dealer! Definitelly get the MDX, however, drive a hundred miles to buy somewhere else.:3: :eek:

The Valencia dealer you're apparently having trouble with is by far the closest dealer to where I live and work, but I didn't buy from them. They were the first place I tried (keep the dollars in the community!), but it didn't work out. Their salesman wasn't actually rude -- he just blew me off.

I purchased from Nelson Van Saant at Pasadena. Excellent experience. Purchase was exactly what I wanted, for exactly the price we agreed upon (to the penny).

Actually, I work 50 ft from the Pasadena dealership. They seem like good folks, but Valencia just told me they could get a sage brush in Dec. I really want that color, and Pasadena says they don't know when they will get it.

keep in mind, even if they didn't refund your money, you could have gotten it back thru a chargeback with your credit card company.

they never delivered anything to you for the amount they charged you.

That is if you are not in a real bad need of a car at this time. Ask to speak to the owner and tell him what happened. It could be the owners policy to add on forced options, if so, it is better to find out now than after you have already received the car.

I'd say this -- if you put a deposit down for the next [fill in color here] MDX that they get, and you verbally agreed to pay MSRP, and you didn't sign any papers, then you don't have much common sense! I would hope that you signed a contract specifying exactly what you're getting and how much you're paying for it. I'd check with another dealership at this point and get it all in writing next time.

I'm not an idiot. If you read the post, I never let them charge my card. Valencia is 100 miles from me. I asked for a fax, but they never sent it, thus they never really got the deposit, but MAN did they want it. You see, I gave the card number waiting for a fax... the next morning there was the phone message etc. Get it, it was really slick. The leagality would be with some verbal contract that I was under the impression we made.
